How will I pay for an attorney after I’ve been injured in an accident? I’m already struggling to pay my bills because i am out of work, and facing mounting medical bills. I know I should consult an attorney and hire one, but the thought of having to pay hundreds of dollars in legal fees scares me. What do I do?
First of all, you should always reach out to an attorney to start the process. It is your call whether or not to hire an attorney, but during an initial consultation (which most times is free), an attorney can direct you to resources and information that might be useful, including how long you have to file a claim in order to protect your rights.
Second of all, most personal injury and worker’s compensation attorneys will take your case on a contingency fee basis, so you won’t have to pay any money up front! But what exactly does contingency fee basis mean?
To put it very simply, a contingent fee agreement means that the attorney you have hired does not get paid unless they achieve a favorable outcome for you. The cliché “we don’t get paid unless you get paid” is accurate! The attorney will pay the expenses for the case up front, and then work hard to obtain a favorable outcome for you. Once a favorable outcome is achieved, the attorney will be paid a percentage (typically 33%) of the settlement funds.
Given that an attorney will typically expend hours upon hours of work for a case, most of them will only take on a case that they believe will be a “winner.” Therefore, you should feel confident that the attorney you hire will work their hardest to obtain the best outcome they can!
